General Terms and Conditions (GTC) for Vacation Apartments
(hereinafter referred to as the "Landlord")
The following regulations generally apply as agreed upon conclusion of the contract for the vacation apartment specified in the booking confirmation. The GTC are available online at https://www.bellevue-fn.de/agb or will gladly be sent by post or email upon request. Details and the complete furnishings correspond to the information on the respective listing page of the Landlord's website.
1. Conclusion of Contract
A contract is formed through the binding booking of a vacation apartment with the Landlord, which can be made via the website, email, or telephone. The contract becomes effective upon written confirmation of the booking by the Landlord. The tenant is obliged to pay the agreed rental price according to the following payment deadlines.
2. Payment / Payment Deadlines
The agreed rental price is due in full no later than 14 days before the start of the trip and must be paid to the account specified by the Landlord (via bank transfer or PayPal). For bookings made less than 14 days before the start of the trip, the total amount is due immediately. If payment deadlines are not met, the Landlord may withdraw from the contract. Non-payment is considered a cancellation by the tenant and entitles the Landlord to re-let the property.
3. Cancellation Conditions
If the tenant cancels the rental contract, they must pay the Landlord compensation in the following amount: Up to the 30th day before the agreed arrival date: no cancellation fee. From the 29th to the 14th day before the agreed arrival date: 50% of the agreed rental price. From the 13th day before the agreed arrival date until the day of arrival: 90% of the agreed rental price. In case of no-show without prior cancellation: 100% of the agreed rental price. The decisive factor for calculating the deadline is the receipt of the written cancellation declaration (email is sufficient) by the Landlord. The tenant reserves the right to prove that the Landlord has incurred no or significantly less damage.
4. Arrival
The rental period begins on the day of arrival with the takeover of the vacation apartment. Check-in is possible between 3:00 PM and 8:00 PM. Deviations from this time window require prior agreement with the Landlord.
5. Departure
The rental period ends on the day of departure with the return of the vacation apartment. Check-out must be completed by 10:00 AM at the latest, but not before 8:00 AM. The apartment must be left in a "broom-clean" and orderly condition by this time (see details in clause 5). Deviations require prior agreement with the Landlord. All keys are to be left inside the apartment. The Landlord or their authorized agent has the right to conduct an inspection.
6. Persons
The rental property is provided only for the persons contractually agreed upon in the booking. The vacation apartment is designed for a maximum of 3 adult persons. Children who have reached the age of 6 are considered full guests and count towards this quota. The minimum occupancy consists of one adult. Subsequent changes to the number or composition of persons require the written permission of the Landlord. This applies in particular to overnight stays of additional persons. In the event of violations, the Landlord is entitled to expel persons not listed in the booking from the vacation apartment. Furthermore, violations may give rise to claims for damages.
7. Pets, Smoking
Bringing pets is not permitted. This also applies to visitors of the tenants. Smoking is generally not permitted inside the vacation apartments or within the buildings. Smoking on the balconies is permitted.
8. Maintenance of the Vacation Apartments
The tenant is obliged to treat the rented premises including inventory with care and to protect them from damage. Damage to the vacation apartment and the property or missing inventory items that occur during the rental period must be reimbursed by the tenant, unless the tenant proves that they or the persons accompanying them are not at fault for the cause of the damage or the missing item. The tenant must notify the Landlord immediately of any findings regarding incomplete inventory or existing or occurring defects in the rental property; otherwise, the Landlord's claims for compensation based thereon remain valid.
9. Obligations and Liability of the Landlord
Upon the effective conclusion of the contract, the Landlord is obliged to provide and hand over the rental property in accordance with the contract. Should the vacation apartment, despite all due care of the Landlord or due to circumstances beyond the Landlord's control (weather disasters, fire, explosion, damage to the building, vandalism, etc.), not be usable by the tenant as agreed, the Landlord shall be liable exclusively up to the amount of the agreed and paid rental price, provided that no intent or gross negligence on the part of the Landlord, its legal representatives or vicarious agents exists. The Landlord is not liable for damages that lie outside its sphere of responsibility, in particular for construction work (including road works) in the neighborhood.
10. Cancellation and Early Termination
The conditions in clause 3 apply to cancellations by the tenant. If the tenant cancels the contract and simultaneously presents a replacement tenant who declares in writing that they accept the agreed conditions, the Landlord will issue a new booking confirmation to them. In the event of successful re-letting for the entire period, the Landlord will refund the rent already paid, minus a flat-rate processing fee of €50.00. The tenant's early departure does not entitle them to a reduction in rent, unless there are serious defects for which the Landlord is responsible that make contractually agreed use impossible. The tenant is obliged to report such defects immediately.
11. Rules of Use – House Rules
The house rules are a binding part of this rental agreement. The current version can be viewed on the Landlord's website at https://www.bellevue-fn.de/hausordnung. The tenant is obliged to comply with them during the stay. The essential rules include in particular: Use of the apartment exclusively by the persons contractually registered (see clause 6). The prohibition of smoking inside the premises. The prohibition of bringing pets. The prohibition of holding parties or events. The obligation to be considerate of neighbors, in particular to observe quiet hours. Compliance with the agreed check-in and check-out times. This list is not exhaustive. The full wording of the house rules provided online is authoritative.
12. Severability Clause and Dispute Resolution
Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. The Landlord is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
